Vote on what you believe in

1. Your project financing options. Would you appreciate the chance to choose whether to pay in full or take the loan, once every scope of work is diagnosed and competitively bid, owners have voted on all non-maintenance improvements, and the community has well structured financing options based on real numbers?

§718.3026(1) · Bylaws 4.2 · Declaration 10.4 · §718.112(2)(f)2.c.(I) · §718.111(1)(d)

2. A revised, independent reserve study. Would you appreciate an independent review of the reserve study, so the deck and pool figures are assessed, not accepted as the Association supplied them? The deck rose 3.6 times over the 2023 study. The pool rose nearly 23 times.

§718.112(2)(g) · §617.0830 · §718.111(1)(d) · Reserve study 8/25/2026, page 33

3. Professional project management. Would you appreciate one plan that underwrites, competitively bids and manages every upcoming project, so you are not hit with another special assessment for poor planning?

§718.112(2)(f) and (g) · Bylaws 6.2 · §718.3026(1) · Bylaws 4.2 · §718.111(1)(a)

4. Transparency and your right to vote. Do you believe you have the right to see every scope of work, know why each item is or is not maintenance, and vote on every non-maintenance improvement over $25,000?

Declaration 10.4 · §718.113(2)(a) · §718.111(12) · Bylaws 9.1

5. What do you want your next Board to address in its first 100 days in office? Do not limit yourself.

Appendix: the issues we hope to put behind us

#What the Board didWhat it violates
1The issue
The Board calls the work "the Improvements" and is collecting $5,200,000 with no owner vote. The non-maintenance items, counted together as one project, are far over $25,000. The maintenance and non-maintenance split promised August 25 was never produced.
The violation
Declaration 10.4
Improvements over $25,000 in a calendar year need approval by a majority of the Voting Interests.
2The issue
Payment is due November 12. The owner vote on the landscape design is promised only afterward.
The violation
§718.113(2)(a), Florida Statutes
No material alteration to the common elements except as the Declaration provides.
3The issue
The $5,200,000 assessment and the loan option were adopted by Board vote alone.
The violation
§718.112(2)(f)2.c.(I), Florida Statutes
A special assessment or loan for reserve study items needs a majority vote of all owners.
4The issue
$3,740,000, 54% of the $6,988,919 project, has no competitive bid. No contract has been executed.
The violation
§718.3026(1), Florida Statutes; Bylaws 4.2
Competitive bids for any contract above 5% of the annual budget. Contracts in writing.
5The issue
Owners must pay with no final diagnosis, no fixed price, and no escrow, true-up or interest terms.
The violation
§718.111(1)(a) and (d), Florida Statutes
Directors are fiduciaries and must act with the care of an ordinarily prudent person.
6The issue
The Board cites the reserve study as the reason. The study's $5,000,000 project and $1,250,000 pool figures were supplied by the Association (pages 50 and 56) and "not audited or independently verified" (page 33).
The violation
§617.0830, Florida Statutes
A director may not rely on a report when he or she knows facts that make reliance unwarranted.
7The issue
Of 50 project records requests from one owner, 12 were answered in full. The oldest has been open since September 7.
The violation
Bylaws 9.1; §718.111(12)(c), Florida Statutes
Official records within 5 working days (Bylaws); willful failure presumed after 10.
8The issue
A loan placement fee goes to the manager's affiliate. No disclosure or approval appears in the minutes before August.
The violation
§468.4335, Florida Statutes
The manager must disclose conflicts; a conflict is presumed without notice and Board approval.
9The issue
The Board's letter describes landscaping work that the special assessment notice does not list.
The violation
§718.112(2)(c)3 and §718.116(10), Florida Statutes
The assessment notice must state the cost and purposes; funds may be used only for those purposes.
